One summer day, while the plaintiff was on the way to the beach with her family, her husband slowed the vehicle to a stop at a red light. The plaintiff was the front seat passenger in the vehicle and turned around to check on their two-year-old daughter in the backseat.
While the plaintiff was turned around, suddenly and without warning, the defendant rear-ended the plaintiff’s vehicle at such a high rate of speed that his vehicle immediately caught fire. The fire department responded to the scene of the crash and the roadway was closed down for several hours.
As a result of being rear-ended by the defendant’s vehicle, the plaintiff suffered serious injuries to her neck and lower back. The plaintiff was in the second trimester of pregnancy with her second child.
The plaintiff was immediately transported by ambulance to the emergency room where she was diagnosed with an L1 compression fracture. She was forced to wear a brace over her torso for the remainder of her pregnancy. However, following the birth of her second child, her symptoms worsened and she ultimately underwent surgical spinal fixation to stabilize the L1 vertebrae fracture.
