After pulling into the breakdown lane of I-93 in Danvers, a successful executive’s car was hit. The plaintiff suffered multiple fractures and internal injuries. In January, a man working on a siding installer fell 12 feet from an icy bed ladder and was rendered unconscious. After cognitive and physical therapy, he regained his ability to walk and care for his basic personal needs but required supervision due to behavioral difficulties associated with the accident. After slipping on debris left by a sub-contractor, a union sheet metal worker underwent two surgeries to address the effects of this fall. After suffering a ruptured cervical disc, a truck driver underwent two surgeries to address his neck injury. After filing a claim for permanent and total disability, the plaintiff was awarded $290,000 in settlement.

Workers’ Compensation – Ruptured Lumbar Disc; $ 335,000
A 48-year-old boiler mechanic with a history of prior back injuries, all of which he did not file worker’s compensation for, injured his back twice in one year as a result of work-related tasks. The second injury significantly impaired his function and required surgery the following year. The plaintiff filed suit after the employer refused to bring him back for work until he was cleared to do so. The case was settled before an Administrative Judge.
Workers’ Compensation Third Party Action – Fractured Ankle; $360,000
After slipping on an incline leading to a beer cooler in Fenway Park, a beer truck driver injured his right ankle and heel and lacerated his elbow. The driver was forced to stop working after his elbow became infected. He later required surgery for his heel injury. A suite was filled against Aramark, the concessionaire at Fenway, and John Harrington, the Trustee of the Trust which owned Fenway Park. After a trial and reduction in the verdict, the case was settled for $360,000.
Slip and Fall – Resulting in Fractured Heel; $267,000
A contracted employee fell on the premises of her Woburn employer, suffering injuries to her left foot and back. Testimony revealed that the washing of the floors of the Woburn store began prior to the time when store personnel were supposed to leave, contrary to company policy. There was also evidence that there were no signs indicating a wet floor. The plaintiff settled the case for $276,000.
Workers’ Compensation -Crush Injury with Traumatic Amputation of 3 Fingers; $300,000
A radio tower mechanic suffered a traumatic amputation of three fingers of his non-dominant hand when the tower skipped from a jack used to lift the tower. The plaintiff successfully pursued a loss of function claim.
Workers’ Compensation – Ruptured Lumbar Disc; $245,000
An employee was awarded permanent and total disability benefits after rupturing his lumbar disk.
Motor Vehicle Accident – Resulting in Subdural Hematoma; Multiple Fractures ; $600,000
After being struck by a motor vehicle while walking home on an unlit road on a rainy night, and after drinking at a local tavern, he rushed to Massachusetts General Hospital where he underwent life-saving brain surgery. He was eventually able to resume employment in his father’s bakery. The driver of the vehicle was found to have a blood-alcohol level of more than the legal maximum several hours after the accident occurred. The case eventually settled for $600,000.
Motor Vehicle Accident/Products Liability – Ruptured Lumbar Disc; $400,000
A 35-year-old truck driver suffered fractured ribs and a broken pelvis after his tractor-trailer rolled at a curve when his breaks failed. Claims were filed against the lessor of the truck, the brake manufacturer, and the repair facility which did the vehicle’s recent brake repair. The case was settled for $60,000. Products Liability – Severe Laceration Resulting Damage to Radial Nerve; $475,000
An employee was assisting his employer in unloading a large piece of un-tempered glass when the sheet collapsed without warning and severely lacerating his right forearm. The sheet of glass was found to have been cut in such a way that it was made weaker, undetectable to the human eye. The case was settled after a three-week trial, for $475,000.
Workers’ Compensation – Multiple injuries; $1.2 Million
After a painter survived a 100-foot fall, he sought counsel more than a year later because he felt the maximum rate he was being paid under the law, was too low. A claim for permanent and total disability benefits was pursued along with a claim to increase benefits awarded in the original Worker’s Compensation Act. The case was settled for $1.2 Million.
