The plaintiff, a guest of the defendant’s hotel in Buffalo, New York, suffered a fractured tooth with resulting infection, after biting down on a stone contained in a cheese and mushroom omelet. The omelet was prepared at an “omelet station” located in the dining room of the hotel’s restaurant. The case was settled prior to trial.
